Scalyr Inc. – Privacy Policy

This Privacy Policy is effective as of April 2021. Scalyr, Inc. (“Scalyr”, “we” or “us”) provides this Privacy Policy to inform users of our policies and procedures regarding the collection, use and disclosure of information, including information relating to an identified or identifiable natural person (“Personal Information“), received from users of our server monitoring and log analysis service and server configuration management service (the “Services”) and this website (the “Website”). By using or accessing Services or the Website, you are accepting the practices described in this Privacy Policy, and you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. 1. Scalyr Services and Customer Data

Scalyr collects, aggregates, and stores configuration settings, log and audit data for its customers. The Services permit customers to ingest, or upload and submit, content to the Services (“Customer Data“). Customer, rather than Scalyr, controls how and if Customer Data is collected and processed. Customers are ultimately responsible to comply with applicable laws and regulations relating to the data uploaded to the Services. It is customers responsibility not to upload and Personal Information nor any other sensitive data, such as but not limited to data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data, health-related data, data concerning a person’s sex life or sexual orientation, financial, or professional secrecy and alike.

Scalyr collects information, under the direction of customers to any of the Services and have no direct relationship with individuals whose information Scalyr may process in connection with one of Scalyr’s customers and/or use of the Services. If you are an individual who interacts with the Services in connection with your relations with a Scalyr customer (such as an employee of one of our customer) and would no longer like your information to be processed by Scalyr in providing the Services to a customer, please contact the customer that you interact with directly.

Scalyr will not share individual configuration settings and disclose log records to third parties except to Scalyr sub-processor(s) and other than aggregated statistics  as described in Section 2.b. and for the purposes described below in Section 2.c.

 

2. Web Services Users and Web Site Visitors

Scalyr collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Scalyr’s purpose in collecting non-personally identifying information is to better understand how Scalyr’s visitors use its Website. From time to time, Scalyr may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Website. As part of your visit to the Website, Scalyr also collects potentially Personal Information like Internet Protocol (IP) addresses. Scalyr does not use such information to identify its visitors and does not disclose such information other than under the circumstances described below.

a. Gathering of Personal Information via the Website

Certain visitors to the Website choose to interact with Scalyr in ways that require Scalyr to gather Personal Information, such as name, company, email address, phone number and country. Such Personal Information is collected via the Website, email, SMS, telephone or other means. The amount and type of information that Scalyr gathers depends on the nature of the interaction as requested by the visitor. In each case, Scalyr collects such Personal Information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Scalyr. Scalyr does not disclose Personal Information other than as described below. Visitors can always refuse to supply Personal Information, with the caveat that it may prevent them from engaging in certain activities.

b. Aggregated Statistics

Scalyr may collect aggregated statistics about the behavior of visitors to its Website and Services. Scalyr does not disclose personally identifying information other than as described below.

c. Protection and Use of Personal Information

Scalyr discloses Personal Information only to those of its employees, contractors, affiliates, and sub-processors that (i) need to know that information in order to process it on Scalyr’s behalf or to provide services available as part of the Services, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors affiliates, and sub-processors may be located outside of your home country; by using the Website or the Services, you consent to the transfer of such information to them. If you are a Scalyr customer, and you wish to execute a Data Processing Agreement including applicable Standard Contractual Clauses, or if you need more information on Scalyr’s sub-processor, please contact us at privacy@scalyr.com. Scalyr will not rent or sell Personal Information to anyone. Other than to its employees, contractors, and affiliates, as described above, Scalyr discloses Personal Information only when required to do so by law, or when Scalyr believes in good faith that disclosure is reasonably necessary to protect the property or rights of Scalyr, third parties, or the public at large. If you are a registered user of the Services and have supplied your email address, Scalyr may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Scalyr and our products. Scalyr takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and Personal Information. d. Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Scalyr uses cookies to help identify and track visitors, their usage of the Services, and their preferences. Scalyr visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Services or visiting the Website, however, it is not possible to log into a Scalyr account with cookies disabled.

e. Links to Other Web Websites

This Privacy Policy applies only to the Services and this Website and not to any third-party sites.

If, at any time after registering to any mailing list or other type of communication via the Website, you change your mind about receiving information from us or about the use of information volunteered by you, please send us a request specifying your choice. 3. International Transfer of Information Collected

Scalyr is part of SentinelOne Inc. group of companies. SentinelOne Inc. is a U.S.-based, global company. Scalyr and its affiliates store Personal Information in various regions primarily within the European Economic Area (the “EEA”) and the United States. To facilitate our global operations, Scalyr and its affiliates may transfer and access such Personal Information from around the world, including from other countries in which the Scalyr and its affiliates have operations for the purposes described in this Policy. We may also transfer your Personal Information to Scalyr third-party sub-processors, who may be located in a different country to you.

 

4. Privacy Policy Changes

Scalyr may change this Policy from time to time, and in Scalyr’s sole discretion. Scalyr encourages visitors to frequently check this page for any changes to this Policy. Your continued use of this site after any change in the Policy will constitute your acceptance of such change.
